1. Preamble

Access and use of the Site and the Application of the company ALLIANZES accessible at the following address: www.picomto.com (hereinafter referred to as “the Site”) and the services offered there are subject to compliance with these General Conditions of Use.

The purpose of these General Conditions is to define the terms and conditions for making the Site and the Application available and the conditions of use of the service.

These General Conditions of Use include the following definitions:

“Application”: designates the Application published by the company ALLIANZES and available for download in particular on Google Play.

“Publisher”: designates the ALLIANZES company.

“Internet user”: any person who browses the Site www.picomto.com who accesses and consults the Site without having a personal account, or one of the services offered on the Site, whatever its quality. , the location where it is located, the terms of connection to the Site, the object and purpose of its access to the Site.

“Site”: designates the website accessible at the address “www.picomto.com”, owned by the Publisher.

“Mobile Terminal”: refers in particular to all smartphones, computer equipment, and digital tablets.

The Site is available anywhere, as long as the minimum technical conditions are met, and in particular in terms of access to the mobile telephone network, Internet network and technical compatibility of the equipment used.

ALLIANZES can never be held responsible for the inaccessibility of the Site for technical reasons.

6. Intellectual property

Copyright:

Brands:
The brands and logos appearing on the Site and the Application are registered and protected trademarks.
Any total or partial reproduction of the brands and/or logos present on the Site, made from elements of the Site, without the express authorization of ALLIANZES constitutes an infringement punishable by articles L.713-2 et seq. of the Code of Intellectual property.

Databases: The databases established by ALLIANZES are protected by copyright as well as by the law of July 1, 1998 transposing into the Intellectual Property Code the European directive of March 11, 1996 relating to legal protection databases. Without written authorization from ALLIANZES, any reproduction, representation, adaptation, translation and/or modification, partial or complete, as well as any substantial qualitative or quantitative extraction to another site is prohibited and punishable by articles L.343-4 et seq. Intellectual Property Code.

User license:
By downloading and installing the Picomto Mobile Application on their Mobile Terminal, the Internet user benefits from a user license if the account has been provided by ALLIANZES beforehand.
The license only gives the right to install the Mobile Application on a Mobile Terminal and to operate it in accordance with its intended purpose.

7. Limited Site Liability

ALLIANZES makes its best efforts to ensure the proper functioning of the Site and the services appearing there, according to the limits of liability of these General Conditions.

Access to the site:

The Site is in principle accessible 24 hours a day, 7 days a week, however, ALLIANZES declines all responsibility, without this list being exhaustive:

In the event of interruption of the Site for technical maintenance operations or updating of published information.
In the event of temporary inability to access the Site (and/or the Websites linked to it) due to technical problems, whatever their origin and provenance.
In the event of contamination by possible computer viruses circulating on the network.

ALLIANZES cannot be held responsible, or considered to have failed to comply with these General Conditions of Use, for any delay or non-performance, when the cause of the delay or non-performance is linked to a case of force majeure as defined by the jurisprudence of French courts and tribunals including the interruption, suspension, reduction or disruption of electricity or other or any interruptions of electronic communications networks or in the event of facts beyond its control.

Intervention of the Site Manager:

ALLIANZES reserves the right to modify the terms, conditions and notices herein at any time, particularly in the event of technical, legal or jurisprudential developments or during the implementation of new services. The user is therefore advised to regularly consult the latest version of the General Conditions of Use available on the Site. Renewed use of the Site as these conditions of use are modified constitutes acceptance, by each Internet user, of the General Conditions of Use in force.

8. Right and responsibility of the user / internet user / mobile user
Responsibility :

Use of the Site is made under the sole and entire responsibility of the Internet User.
The Internet user is solely responsible for the information he communicates from the Site.
In the event of abnormal use or illegal exploitation of the Site, the Internet user is solely responsible for damage caused to third parties and the consequences of claims or actions that could result therefrom.

ALLIANZES specifies that the use of hypertext links can lead the Internet user to other websites or applications, independent of the Site.

10. Clause independence

If any part of these General Conditions of Use should prove to be void, invalid or unenforceable for any reason whatsoever, the term or terms in question will be declared non-existent and the remaining terms will retain their full force and scope and continue to be applicable. 11. Applicable rights and attribution of jurisdiction

Carry out operations relating to prospecting: sending marketing and commercial mailings.

ALLIANZES is the sole recipient of this personal data. The personnel authorized to process personal data are the marketing department, the sales department, the services responsible for handling customer relations and prospecting, the administrative services, the technical service and the support service.
